1. Introduction

Welcome to our website. To avoid all misunderstandings, please read these terms of business carefully. These terms relate to The Jolly Indian Sailor’s cuisine supplied to you through our website and should be read in conjunction with the our Privacy Policy which shall also apply.

You will be asked to expressly agree to these terms of business before you purchase from our website.

3. Order process

Select your delivery date

Select the Tiffin Menu you wish to purchase Tiffin for Two or The Party Tiffins

Select the quantity of Tiffins you require.

Provide your address and contact details with payment.

Delivered to your doorstep every Friday between 5-8pm

Collections, your tiffins are collected on Sunday mornings between 10am & 12pm.

Occasionally, we may be out of stock of a particular meal or ingredients and in this case, we reserve the right to substitute an alternative dish within your plan. We will email you in advance if this is the case and advise you of the allergens list.

4. The Tiffin for Two

If you suffer from any food allergies, please check the ingredient list for your chosen meal for any allergens. If you are in any doubt, please do contact us BEFORE DELIVERY.

Your Tiffin for Two meal will be delivered in a re-usable tiffin tin that will be collected on Sunday morning 10-12pm.
Please ensure that it is washed and clean before collection. Storage, cooking and re-heating instructions must be followed closely.

Make sure that re-heated food is piping hot throughout.

5. Price and payment

Prices for our Tiffin Meals are quoted on our website.

Payment must be made upon submission of your order and will be collected immediately.

We may withhold deliveries and/or cancel the contract between us if the payment is not received from you in full in cleared funds by Wednesday 6pm proceeding the Friday you have selected for delivery.

The prices on the website include all value added taxes (where applicable).

Prices for Tiffins for Two are liable to change at any time, but changes will not affect orders that have already been placed and we will give you advance warning if our prices are likely to change.

Deposit & Return Scheme:

We operate a deposit and return scheme. At point of purchase a £15 refundable tin deposit is added to your purchase for every Tiffin you purchase.

The Tin deposit is refunded in full on Monday mornings, when all tiffin tin and been collected and accounted for.

6. Delivery policy

We deliver only to the villages listed on our website.

All orders are delivered by us at specified times or days for certain areas.

Deliveries are made every Friday evening between 5pm-8pm

Please let us know your preferred safe space, protected from the elements, if you’re not going to be in.

We endeavour to deliver all Tiffin Tins before 8pm on your chosen delivery day, and will keep in touch if it looks to be later than this (ie. road works, etc)

Please be aware that by ordering with us you agree for your phone number to be passed on to our delivery company if we use a third party in the future.

Neither they nor The Jolly Indian Sailor will use your personal information for anything other than the intended purpose which is to ensure your Tiffin for Two gets to you in time for dinner.

If you have entered alternative delivery instructions (for example “leave with a neighbour” or “leave in shed”) then this is entirely at your own risk and you will be responsible if theTiffin Tin goes missing. It is agreed that anyone at the delivery address is entitled to accept delivery.

If you’re not at home when we deliver, and we can’t find a safe space to leave your delivery, we will need to return The Jolly Indian Sailor and you will not be refunded in this event. If we can find a safe space to leave it, we’ll text you. Your delivery is Heat, Eat, Enjoy, it will be delivered cold will need to be placed in the fridge within 1 hour or heated immediately.

Please note we cannot accept liability for any deliveries that are left out or uneaten for longer than our recommendations.

7. Changing your mind and cancellations

Changing your mind: You may cancel your order with us BEFORE 6pm on the Wednesday prior to your delivery on Friday by writing to us at, hello@thejollyindiansailor.com

Orders cancelled after this time will still be charged in full. Due to the perishable nature of the Tiffins for Two, you do not have a right to change your mind after delivery of the Tiffin for Two, under the Consumer Contracts Regulations. In the unlikely event that you are not satisfied with the quality of the meal or have any other complaint, please do contact us right away. All refunds will be entirely at our discretion.

8. Statutory rights

Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).

9. Refunds and exchanges

Orders close and you are billed by 6pm on Wednesday. We’re sorry but cancellations on Thursdays and Fridays are not eligible for any refund, you are able to redirect your delivery and gift a nearby neighbour. All refunds will be entirely at our discretion.

10. Limitations and exclusions of liability

Nothing in the terms of sale will: (a) limit or exclude the liability of a party for death or personal injury resulting from negligence; (b) limit or exclude the liability of a party for fraud or fraudulent misrepresentation by that party; (c) limit or exclude any liability of a party under Section 12, 13, 14 or 15 of the Sale of Goods Act 1979 or Part I of the Consumer Protection Act 1987; (d) limit or exclude any liability of a party in any way that is not permitted under applicable law.
We will not be liable to you in respect of any losses arising out of any event or series of events beyond our reasonable control.

We will not be liable to you in respect of any business losses, such as loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

11. Other important terms

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms of use. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. If we fail to insist that you perform any of your obligations under these terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

If you are a consumer, please note that these terms are governed by English law. This means a Contract for the purchase of Tiffins for Two through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland

When we refer to “in writing” in these terms, this will include e-mail.
